18 U.S.C. § 2257 Compliance Statement

Compliance Assertion

All visual depictions of actual sexually explicit conduct appearing on or otherwise contained in the website operated at Erotic Effect (the “Platform”) — to the extent that ISM Studio LLC (“the Operator”) is a “producer” within the meaning of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 — comply with the requirements of those provisions.

All performers depicted in such visual depictions were at least eighteen (18) years of age at the time the depictions were created. The Operator obtains and inspects valid, government-issued photo identification from each performer prior to publication and maintains the records required by the statute and regulations.

Records Custodian

The records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 with respect to all visual depictions of actual sexually explicit conduct for which the Operator is the “primary producer” or the “secondary producer,” as those terms are defined in 28 C.F.R. § 75.1(c) and (d), are kept by the Custodian of Records at the following location:

Hours of Inspection

Records are available for inspection during normal business hours, Monday through Friday, 9:00 a.m. to 5:00 p.m. Mountain Time, in accordance with 28 C.F.R. § 75.5(c)(1). Inspections are conducted by appointment with the Custodian of Records.

Scope

This statement applies to all visual depictions of actual sexually explicit conduct that appear on the Platform and for which the Operator is a primary or secondary producer as defined by 28 C.F.R. § 75.1(c) and (d).

For depictions where another party is the primary producer (for example, where a creator uploads content they themselves produced), records are also maintained by that primary producer at the address designated in their own § 2257 statement. The Operator collects from each creator, and verifies before publication, the records required for secondary-producer compliance.

Exclusions

The Operator is not the producer (primary or secondary) of, and does not maintain § 2257 records for, the following:

• Content that is hyperlinked from, embedded from, or otherwise sourced from third-party websites that the Operator does not control;
• User-generated content that does not depict actual sexually explicit conduct as defined by 18 U.S.C. § 2256(2)(A)(i)–(iv);
• Material consisting solely of depictions exempt under 18 U.S.C. § 2257(h) or 28 C.F.R. § 75.1(g) (including, where applicable, depictions covered by the § 2257A exemption for material that does not depict actual sexually explicit conduct, subject to that provision’s certification process);
• News reports, commentary, advertising, or other depictions that are excluded from the statute’s scope.

No Authority Beyond the Statute

This statement is provided to comply with 18 U.S.C. § 2257 and 28 C.F.R. Part 75. Nothing in this statement is intended to expand records-keeping obligations beyond those required by the statute and regulations, and nothing here constitutes a waiver of any constitutional or statutory defense.
