Terms of Service

Welcome to Erotic Effect (the “Platform”), operated by ISM Studio LLC (“we,” “us,” or “our”). These Terms of Service (the “Terms”) form a binding contract between you and us. By creating an account, accessing the Platform, purchasing a subscription, or uploading content, you agree to these Terms. If you do not agree, do not use the Platform.

This is an adult-content platform. The Platform is intended for adults only and is not directed to anyone under 18.

1. Eligibility

To use the Platform, you must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) and legally able to enter contracts. You must not be located in a jurisdiction where access to adult content is unlawful, and you must comply with all laws in your jurisdiction at all times.

We may deny service or terminate accounts at our discretion, including based on geolocation, suspected age misrepresentation, or non-compliance with these Terms.

2. Account Registration and Verification

You must provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

Creators (users who upload content for sale or subscription) must additionally:

  • Submit valid government-issued photo identification for age verification;
  • Complete identity verification through our third-party verification provider;
  • Provide and maintain records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for any content depicting actual sexually explicit conduct (see our 2257 Statement);
  • Provide written consent for each individual depicted in any content (see our Consent Statement);
  • Complete tax documentation (e.g., W-9 or W-8BEN) before receiving payouts.

3. Content Ownership and License

You retain ownership of all intellectual property rights in content you upload (“Creator Content”). By uploading Creator Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, transcode, and distribute the Creator Content solely for the purpose of operating the Platform, marketing the Platform, and providing the services you have requested. This license terminates when you remove the Creator Content from the Platform, except to the extent we must retain copies to comply with law (including 2257 records-keeping requirements) or to enforce these Terms.

You represent and warrant that you own or have all necessary rights to the Creator Content, that you have all required consents and releases from any individual depicted, and that your content does not infringe any third-party rights.

4. Prohibited Content and Conduct

We have zero tolerance for the following. Posting any of this content will result in immediate account termination, forfeiture of pending payouts, preservation of evidence, and where required by law, a report to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement.

  • Child Sexual Abuse Material (CSAM) or any content depicting, suggesting, or sexualizing minors in any context — zero tolerance, immediate ban, mandatory NCMEC report;
  • Non-consensual content, including non-consensual intimate imagery (“revenge porn”);
  • Content depicting human trafficking, coercion, or exploitation;
  • Bestiality;
  • Necrophilia;
  • Content depicting incest (whether actual or fictionalized);
  • Deepfakes or synthetic media depicting any identifiable person without that person’s explicit written consent;
  • Content depicting weapons in a sexual context, the sale of weapons, or the sale of controlled substances;
  • Content depicting scat, blood, urine in non-consensual contexts, or other categories prohibited by our payment processors;
  • Content depicting unconscious or impaired persons;
  • Content depicting violent or non-consensual acts of any kind.

You also agree not to: scrape the Platform; reverse-engineer it; circumvent payment, age verification, or geolocation controls; impersonate another person; harass other users; or use the Platform for any unlawful purpose.

5. Payments

Payments on the Platform are processed by CCBill, LLC (the “Payment Processor”), which acts as merchant of record for adult-content transactions. By making a purchase, you also agree to CCBill’s terms.

We charge a platform fee of 20% on creator earnings, in addition to processing fees charged by CCBill. Payouts to creators are issued on a bi-weekly basis, subject to a minimum threshold and any holds required by the Payment Processor for chargeback risk management. Currency, taxes, and fees are disclosed at checkout.

All purchases of digital content (subscriptions, pay-per-view content, tips) are final. See our Refund Policy.

6. Termination

We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. You may close your account at any time by emailing support@eroticeffectstudios.com. Upon termination:

  • Your access to the Platform ends immediately;
  • Pending payouts may be held to cover chargebacks, refunds, or fraud investigation;
  • We will retain records as required by law (including 2257 records and tax records);
  • Sections of these Terms that by their nature should survive (ownership, indemnification, dispute resolution, limitation of liability) survive termination.

7. Dispute Resolution; Arbitration; No Class Actions

Please read this section carefully — it affects your legal rights. You and we agree that any dispute arising out of or relating to these Terms or the Platform shall be resolved by final and binding individual arbitration administered by a recognized arbitration provider, seated in Wyoming, under that provider’s consumer rules. You and we waive any right to a jury trial and any right to participate in a class action or class arbitration. Either party may bring a qualifying claim in small-claims court instead of arbitration. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual-property infringement.

8. Disclaimers

The Platform is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that any specific creator content will remain available.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities, even if we have been advised of the possibility of such damages. Our aggregate liability for all claims arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the total amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars (US$100).

10. Indemnification

You agree to defend, indemnify, and hold harmless ISM Studio LLC, its officers, directors, employees, and agents from any claim, loss, or liability (including reasonable attorneys’ fees) arising out of your content, your use of the Platform, your violation of these Terms, or your violation of any third-party right.

11. Modifications

We may update these Terms from time to time. Material changes will take effect thirty (30) days after we post the updated Terms and notify users by email or in-app notice. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Platform before the effective date.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

13. Miscellaneous

These Terms are the entire agreement between you and us regarding the Platform and supersede prior agreements. If any provision is held unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
